Today, the Attorney General’s Office filed a response in the lawsuit regarding ballot language. Pursuant to its statutory duty, the Attorney General’s Office provided the Secretary of State with ballot language consistent with and reflective of the language used by the Legislature itself. When passing LB 268, the Legislature expressed the purpose of their amendment to LB 268. The Judiciary Committee Statement explained it was to eliminate the death penalty and “change the maximum penalty for first degree murder in Nebraska from death to life imprisonment”. AM 754 became LB 268 when adopted by the Legislature on April 16, 2015.
