The Nebraska Attorney General’s Office is seeking an experienced attorney to serve as Bureau Chief of the Medicaid Fraud and Patient Abuse Unit (MFPAU), a federally certified Medicaid Fraud Control Unit responsible for investigating and prosecuting Medicaid provider fraud and patient abuse, and neglect statewide. The Bureau Chief directs all Unit operations, leads a multi-disciplinary team of attorneys, investigators, and auditors, and serves as the primary liaison to federal partners, including HHS-OIG and the U.S. Attorney’s Offices.

 

Examples of Work Performed

  • Direct all MFPAU operations, including strategic direction, case prioritization, and staff supervision.

  • Supervise assistant attorneys general, investigators, and auditors on complex criminal and civil healthcare fraud matters.

  • Lead criminal prosecutions and civil enforcement actions involving Medicaid provider fraud, patient abuse, neglect, and financial exploitation.

  • Review and authorize investigative actions, charging decisions, civil complaints, and settlement agreements.

  • Manage federal grant compliance and annual OIG recertification submissions.

  • Serve as primary liaison to HHS-OIG, U.S. Attorney’s Offices, DHHS, and NAMFCU.

  • Advise the Attorney General on healthcare fraud, patient protection, and MFPAU statutory obligations.

 

Requirements

  • Graduation from an ABA-accredited law school.

  • Licensed to practice law in Nebraska, or clear ability to be licensed by motion.

  • Minimum of seven years of litigation experience, including significant criminal prosecution or complex civil litigation experience.

  • Prior supervisory or leadership experience.

  • Excellent legal writing skills, professional judgment, and commitment to public service.

 

Preferred Qualifications

  • Ten or more years of criminal prosecution or complex civil litigation experience.

  • Experience with Medicaid fraud, healthcare fraud, white-collar crime, or False Claims Act litigation.

  • Experience leading a multi-disciplinary investigative or prosecutorial unit.

  • Familiarity with federal MFCU grant requirements and OIG recertification processes.

The Transportation Bureau of the Nebraska Attorney General’s Office is seeking a highly qualified and skilled litigator and legal advisor. This attorney will assist the Nebraska Department of Transportation with some of its most complex issues and will focus on highway construction issues, construction contractor claims, the construction bid letting process, and alternative project delivery methods. 

 

This attorney is expected to be a skilled litigator with courtroom experience in important litigation and should be interested in litigating various types of cases that arise within a dynamic and driven transportation agency with 1900 plus employees and 10,000 miles of highway property.  Examples of the types of litigation handled by Bureau attorneys range from contract law, property law, and personal injury, and include matters such as condemnation actions, inverse condemnations, tort claims, employment law issues, and workers compensation.  Experience in each of these areas is not required, but an interest in handling various types of litigated matters is strongly preferred.  Compensation would be commensurate with skills and experience, within the range of comparably qualified litigators in State or local government practice.

 

The Transportation Bureau will allow the attorney to further develop litigation and advising skills and will provide you with the time necessary to litigate cases in a way that will make positive results more likely.  The attorney will also work closely with NDOT officials to make sure the Department is best positioned to minimize and mitigate disputes and claims that may result in litigation.

The Nebraska Department of Justice / Nebraska Attorney General’s Office is currently seeking applicants for the position of Assistant Attorney General (“AAG”) in the Office's Agriculture, Environment, and Natural Resources (“AENR”) Bureau. In the AENR Bureau, the AAG will appear on behalf of, and in defense of, State agencies and boards in state and federal courts regarding agricultural, environmental, water, and other natural resources-related matters with potential for appellate practice. While environmental and natural resources law experience is preferred, the position allows for experience in a variety of practice areas including contracts, APA claims, rule and regulation review, tort claims, property law and providing legal counsel to agencies.  Excellent legal research and writing skills required. 

Qualifications / Requirements

REQUIREMENTS: Graduation from an ABA accredited law school and a license to practice law in Nebraska, or clear ability to be licensed in Nebraska by motion;
Excellent legal writing skills and demonstrated work ethic.

PREFERRED:  Legal experience in a private law firm or government agency, which may include service as a judicial clerk.  Two or more years of general civil litigation or environmental law experience.  Prior experience in motions practice, depositions, trial, and appearance before state or federal courts.  Demonstrated subject matter expertise in the relevant position.

The Nebraska Department of Justice is currently seeking an attorney for the position of Assistant Solicitor General in the Office of the Solicitor General. This unique role affords bright and motivated attorneys the opportunity to serve the public, brief and argue cases before the Nebraska Supreme Court and federal courts of appeals, and write merits and amicus briefs before the United States Supreme Court.

The Office of the Solicitor General frequently represents the State, its officers, and agencies in cases presenting high-profile or high-stakes questions. The Office of the Solicitor General also provides legal advice to the Attorney General, drafts formal opinions of the Attorney General, and advises on the State’s participation in multi-state litigation. In addition to fulfilling these duties, the Assistant Solicitor General will also research and propose ideas for affirmative litigation to advance the State’s interests.

The successful candidate will have excellent legal writing skills and legal judgment. The successful candidate must also be able to efficiently research and analyze complex legal problems. Some travel may be required.

The Nebraska Attorney General’s Office is seeking a Senior Auditor in the Medicaid Fraud and Patient Abuse Unit (MFPAU), a federally certified Medicaid Fraud Control Unit responsible for investigating and prosecuting Medicaid provider fraud and patient abuse/neglect statewide. 

 

The Senior Auditor supports the Medicaid Fraud and Patient Abuse Unit by working in partnership with its attorneys, investigators, and data analysts to conduct complex, long-term healthcare fraud investigations into schemes committed by providers of medical services to Medicaid recipients, cases of the misuse of patient personal funds, and cases of patient abuse and neglect.  The Senior Auditor will work under the supervision of the Chief Auditor.

 

RESPONSIBILITIES

  • Perform financial investigations of complex white-collar crime cases and provide necessary facts upon which criminal and civil complaints can be filed.
  • Review and analyze medical, financial and accounting documents to determine patterns or trends that may suggest fraudulent activities.
  • Collect, sort, and analyze data including, but not limited to, Medicaid claims data.
  • Conduct and/or assist with interviews of victims, witnesses and suspects.
  • Write detailed, clear and concise reports.
  • Create and/or compile reports, spreadsheets, and graphs documenting findings and summarizing data.
  • Provide courtroom testimony.

 

QUALIFICATIONS

  • A minimum of a four (4) year college degree, either specifically in accounting, or a closely related business field.

  • Minimum of three (3) years experience in accounting or auditing.

  • Excellent analytical, communication, and organizational skills.

  • The ability to function as an integral part of an investigative team (including attorneys, auditors, and law enforcement) and work in a group setting. 

  • Ability to prepare clear and comprehensive reports and explain his/her findings based off data that was gathered, compiled, and analyzed.
  • Proficiency in fundamental computer applications, including Microsoft Outlook, Word, Excel, Access, and PowerPoint.

     

PREFERRED SKILLS

  • Designation as a Certified Fraud Examiner (CFE).

  • Knowledge of the healthcare industry and medical coding concepts (CPT, HCPCS, ICD-9/10, DRGs) and/or experience analyzing health care claims data.

  • Experience with statistical sampling and/or advanced statistical training. 

  • Experience with application of state statutes, agency rules and regulations and court/administrative hearings process.

The Nebraska Attorney General’s Office is seeking a Sworn Investigator in the Medicaid Fraud and Patient Abuse Unit (MFPAU), a federally certified Medicaid Fraud Control Unit responsible for investigating and prosecuting Medicaid provider fraud and patient abuse/neglect statewide. 

 

The Investigator will work collaboratively with other Medicaid Fraud and Patient Abuse Unit staff along with local, state and federal agencies to investigate allegations of fraud in the Medicaid program and/or abuse or neglect in Medicaid funded facilities.  They perform all phases of an investigation from the central office and in the field. Typical tasks include identifying and collecting evidence, conducting victim, witness and suspect interviews, extensive report writing, writing arrest warrant affidavits, writing search warrant affidavits and search warrants, performing basic analysis of Medicaid providers’ billings to detect fraudulent schemes and abnormal patterns, preparing analytical charts, operating investigative equipment, conducting surveillance, serving subpoenas, assisting the audit and legal staff with case development, and testifying in court.   

 

QUALIFICATIONS AND REQUIREMENTS

  • Nebraska law enforcement certification including meeting or exceeding annual mandatory continuing education requirements required. 

  • Ability to be commissioned as a Deputy State Sheriff required.

  • Previous investigative experience strongly preferred. 

  • The ability to function as an integral part of an investigative team (including attorneys, auditors, and law enforcement) and work in a group setting. 

  • Graduation from an accredited four-year college or university with a major in criminal justice, law enforcement, police science, accounting, finance or business, and a minimum of one year of experience in white-collar investigations preferred.  Substantial experience may be substituted for college degree. 

  • Proficiency in standard office software and systems, including Microsoft Outlook, Word, and Excel. 

  • Certified Fraud Examiner designation preferred. 

  • Knowledge of relevant white-collar law enforcement or criminal investigation techniques preferred. 

  • Experience with application of state statutes, agency rules and regulations and court/administrative hearings process preferred.
