US Supreme Court to Hear Pender Case

In May, the Nebraska Attorney General’s Office asked the United States Supreme Court to resolve the issue of whether the Village of Pender, Nebraska, is within the boundaries of the Omaha Indian Reservation. Several lower federal courts had previously agreed with the Omaha Tribe and the Federal Government that Pender is on the Reservation, despite over a century of treatment to the contrary. The lower courts’ rulings would subject Pender residents to Tribal taxes and regulations for the first time. Today, the U.S. Supreme Court granted the Attorney General’s request and will hear the case next year.
