Death Penalty Petition Process

The Nebraska Constitution allows that the electorate can repeal laws passed by the Legislature through the election referendum process. To initiate this process, the electorate can suspend any law passed by the Legislature prior to its enactment, by providing to the Secretary of State petition signatures of 10% of the registered voters. When the signatures are submitted, a verification process takes place through the direction of the Secretary of State and of the different appropriate county officials. During this verification process, the signatures submitted to the Secretary of State are presumptively valid until determined otherwise.
