The Nebraska Attorney General’s Office is seeking applicants for the position of Assistant Attorney General to serve as the primary antitrust attorney in the Consumer Protection Bureau. 

The Consumer Protection Bureau plays a central role in enforcing state and federal laws against deceptive, fraudulent, and unfair business practices, including antitrust and monopolization matters. Attorneys in the Bureau manage their own cases, develop legal theories, and help bring consequential matters to resolution with the support of a strong, collegial team, making this an opportunity to build deep antitrust experience while also contributing to the Bureau’s broader consumer-protection mission.

Examples of Work Performed

• Investigate potential violations of state and federal antitrust laws, including monopolization, price-fixing, bid rigging, market allocation schemes, and other anticompetitive conduct.

• Conduct civil antitrust litigation from initiation through resolution, including investigation, civil investigative demands, discovery, depositions, motions practice, hearings, and trial.

• Review proposed mergers and acquisitions to assess competitive impact and advise on enforcement options.

• Draft complaints, motions, briefs, civil investigative demands, consent decrees, and other legal documents in antitrust and consumer protection matters.

• Perform legal research and prepare written analyses on complex antitrust and consumer protection issues.

• Advise Bureau leadership and the Attorney General on matters involving antitrust law, market competition, and consumer protection enforcement.

• Handle select consumer protection matters involving deceptive trade practices and unfair business practices as assigned. 

   

Requirements

• Graduation from an ABA-accredited law school.

• Licensed to practice law in Nebraska, or a clear ability to be licensed in Nebraska by motion. 

• Minimum of three years of experience in antitrust law, including mergers, anticompetition counseling, litigation, or regulatory practice in a private law firm, government agency, or enforcement body, or a minimum of three years of litigation experience that includes antitrust matters.

• Excellent legal research and writing skills and strong professional judgment.

• Demonstrated work ethic, initiative, and commitment to public service.

Preferred Qualifications

• Experience in state or federal antitrust enforcement.

• Familiarity with merger review, civil investigative demand practice, or multimarket investigation.

• Economics background or experience conducting economic analysis. 

• Judicial clerkship experience.

• Conduct enforcement and oversee matters related to scams, fraud, impersonation, foreign agents, data privacy, and consumer protection, including investigations, takedowns, cease and desist efforts, settlement demands, and enforcement actions. 

• Review and evaluate consumer complaints, interview consumers and witnesses, issue and enforce civil investigative demands and subpoenas, take testimony, and negotiate appropriate resolutions.

• Draft complaints, motions, briefs, civil investigative demands, consent decrees, assurances of voluntary compliance, and other legal documents in consumer protection matters.

• Negotiate and draft settlements, restitution plans, and injunctive terms, and monitor compliance with negotiated resolutions.

• Participate in multistate investigations and joint enforcement actions in partnership with other state attorneys general and federal agencies.

• Perform legal research and prepare written analyses on complex consumer protection issues.

• Advise Bureau leadership and the Attorney General on matters involving consumer protection enforcement, emerging marketplace practices, and proposed legislation or rules.

• Support consumer education and outreach efforts as assigned.

Requirements

• Graduation from an ABA-accredited law school.

• Licensed to practice law in Nebraska, or a clear ability to be licensed in Nebraska by motion. 

• Excellent legal research and writing skills and strong professional judgment.

• Demonstrated work ethic, initiative, and commitment to public service.

Preferred Qualifications

• Legal experience in a private law firm, government agency, or enforcement body, which may include service as a judicial clerk.

• Civil litigation experience, including motions practice, depositions, trial, and appearances before state or federal courts.

• Experience in consumer protection, deceptive trade practices, or other government enforcement, regulatory, or complex civil litigation.

• Familiarity with civil investigative demand practice or multistate investigations.

The Nebraska Department of Justice is seeking an attorney to serve as Assistant Solicitor General in the Office of the Solicitor General. 

The Office of the Solicitor General frequently represents the State, its officers, and agencies in cases presenting high-profile or high-stakes questions. The Office of the Solicitor General also provides legal advice to the Attorney General, drafts formal opinions of the Attorney General, and advises on the State’s participation in multi-state litigation. In addition to fulfilling these duties, the Assistant Solicitor General will also research and propose ideas for affirmative litigation to advance the State’s interests.

• Brief and argue cases before the Nebraska Supreme Court and federal courts of appeals 
• Draft merits and amicus briefs before the United States Supreme Court
